1. ACCEPTANCE OF TERMS AND CONDITIONS
Q Tuition Agency (“Q Tuition”) welcomes you. Q Tuition provides services to you, subject to the following terms and conditions, which may be updated by us from time to time without prior notice to you. 2. DESCRIPTION OF SERVICE
Q Tuition provides a matching service for tutors and entities who need a tutor, (they will all be refered to as “Student”). Each request for a tutor will be referred to as an “Assignment”. When you register as a tutor, you open an Account. The coordinators accessing the information in your Account (“Registration Data”) will contact registered tutors through the contact information that tutors have provided in the Account when there are suitable assignments for the individual tutors. Tutors hereby understand that being contacted by the coordinators for a particular assignment does not guarantee the Assignment allocation to the contacted tutor.
3. YOUR REGISTRATION OBLIGATIONS
In consideration of your registration with Q Tuition, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of Singapore or other applicable jurisdiction. You also agree to:
(a) provide true, accurate, current and complete information about yourself as prompted by the Tutor Registration Form and
(b) maintain and promptly update your information data to keep it true, accurate, current and complete at all times. If you provide any information that is untrue, inaccurate, not current or incomplete, or in any situation where Q Tuition has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Q Tuition has the right to suspend or terminate your account and refuse any and/or all current or future use of the Q Tuition service.
4. INDEMNITY
You agree to indemnify and hold Q Tuition, and its subsidiaries, affiliates, officers, agents, or other partners, and employees, harmless from any claim or demand, including but not limited to reasonable attorneys' fees, made by any third party due to or arising out of your misconduct, inaccurate information from your Registration Data, violation of the Terms and Conditions, or violation of any rights of another.
5. CONFIDENTIALITY
The information you provide in the Registration Data is kept strictly confidential to Q Tuition.
6. QUALITY ASSURANCE
Tutors should be competent in the subjects they wish to teach. This means that they should have good grades in those subjects.
On the 1st tuition session, Tutor is requested to show the Parent / Student the following:
(a) Identity Card
(b) A copy of examination results
(c) If you are a school teacher or ex-school teacher, please show proof of recognised teaching qualifications.
Tutors are to be professional in their personal conduct. Parents/Students can report to Q Tuition on tutors’ unprofessional conduct.
7. REGISTRATION CHARGES
Registration with Q Tuition for tuition assignments is free.
8. ASSIGNMENT REMUNERATION
As a tuition agency, Q Tuition quotes the market rate according to the Assignment criteria. Tutors may choose to accept or negotiate the price when they are contacted for the Assignment. Tutors are paid by the Students at the end of every tuition cycle, which is the total number of lessons for 4 weeks, or otherwise arranged between the Student and the tutor.
You understand and agree that all remuneration of the first half of the first tuition cycle of an Assignment belongs to Q Tuition. Q Tuition will collect 50% of the remuneration during 1st half of the 1st tuition cycle, while tutor will collect the remaining 50% from the Student at the end of the tuition cycle. In the event that an assignment is requested to be terminated prematurely either by the Student or the tutor before the first tuition cycle ends, you are only entitled to 50% of the remuneration for the number of hours covered.
Q Tuition is not liable to pay any remuneration to the tutor regardless of the event and scenario. You also understand and agree that it is your duty and not Q Tuition’s to request for outstanding payment from the Students to be collected.
9. MODIFICATIONS TO SERVICE
Q Tuition reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that Q Tuition shall not be liable to you or to any third party for any modification, suspension or discontinuance of the service.
10. REPLACEMENT OF TUTOR
If for any reason Student wishes to replace the tutor, Student can contact Q Tuition for the replacement. If it is within the 1st month, Student will have to pay the pro-rated tuition fees based on the number of lessons being conducted; 50% of the fees to Q Tuition and 50% to the Tutor.
11. ASSIGNMENT TERMINATION
There are no contract between the Student and the tutor for an Assignment unless otherwise arranged. You hereby understand and agree that if you break any contractual agreement, you will be liable for all claims and damages indemnified by the contractual parties involved. After you have agreed to take up an Assignment and a commencement date has been arranged between the Student and you, you understand and agree that in the event that you wish to withdraw from the Assignment before the first lesson, you must give Q Tuition a minimum of two days’ notice.
